1. Agreement to Terms

By downloading, installing, or using Kavach VPN ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Kavach VPN ("we," "us," or "our").

2. Description of Service

Kavach VPN provides:

• Virtual Private Network (VPN): Secure, encrypted internet connection through our global server network
• NetShield: DNS-based filtering to block advertisements, trackers, and malware
• Privacy Protection: No-logs policy ensuring your online activities remain private

3. Eligibility

To use Kavach VPN, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using VPN services under applicable laws

By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• A secure password

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and keep your account information updated.

5. Subscription and Payment

5.1 Free Tier

We offer a free tier with limited features. The free tier may be subject to:

• Server access limitations
• Feature restrictions
• Usage limits

5.2 Paid Subscriptions

Paid subscriptions ("Pro" plans) provide additional features including:

• Access to all server locations
• All NetShield protection tiers
• Priority support

5.3 Payment Terms

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Payment is processed through Stripe
• Prices are in USD unless otherwise specified
• You authorize us to charge your payment method on a recurring basis

5.4 Automatic Renewal

Subscriptions automatically renew unless:

• You cancel before the renewal date
• We terminate your account
• Payment fails

5.5 Refund Policy

Refunds are at our discretion for subscriptions beyond the guarantee period. No refunds for accounts terminated due to Terms violations.

5.6 Price Changes

We may change subscription prices with 30 days' notice. Price changes take effect at your next renewal.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use Kavach VPN for:

• ✓ Protecting your privacy and security online
• ✓ Accessing region-restricted content where legally permitted
• ✓ Securing your connection on public Wi-Fi networks
• ✓ Bypassing censorship in accordance with local laws
• ✓ Any other lawful purpose

6.2 Prohibited Uses

You may NOT use Kavach VPN for:

Illegal Activities

• ❌ Any activity that violates applicable laws or regulations
• ❌ Distribution of illegal content
• ❌ Fraud, identity theft, or financial crimes
• ❌ Child exploitation material (ZERO TOLERANCE)
• ❌ Terrorism or incitement of violence
• ❌ Human trafficking

Network Abuse

• ❌ Sending spam or unsolicited bulk communications
• ❌ Launching denial-of-service (DoS/DDoS) attacks
• ❌ Port scanning or network probing
• ❌ Attempting to exploit vulnerabilities
• ❌ Unauthorized access to systems or networks

Service Abuse

• ❌ Sharing your account with others
• ❌ Reselling or redistributing the Service
• ❌ Circumventing usage limits or restrictions
• ❌ Reverse engineering the application
• ❌ Interfering with other users' access

Harmful Activities

• ❌ Distributing malware, viruses, or harmful code
• ❌ Phishing or social engineering attacks
• ❌ Harassment, stalking, or threatening behavior
• ❌ Copyright infringement or piracy

• User interface and design

• Documentation and content

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7.3 Restrictions

You may not:

• Copy, modify, or distribute the software
• Reverse engineer, decompile, or disassemble the software
• Remove any copyright or proprietary notices
• Use our trademarks without permission

7.4 Open Source Components

Kavach VPN uses open-source components, including WireGuard®. These components are subject to their respective licenses.

WireGuard® is a registered trademark of Jason A. Donenfeld.

8. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to our Privacy Policy.

9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY

9.2 No Guarantee of Anonymity

While we take extensive measures to protect your privacy:

• We cannot guarantee complete anonymity
• VPNs have technical limitations
• Your actions outside the VPN may reveal your identity
• Correlation attacks and other advanced techniques may compromise privacy

9.3 Service Availability

We do not guarantee:

• Uninterrupted or error-free service
• Specific connection speeds
• Access to all content or services
• Compatibility with all devices or networks

9.4 Third-Party Services

We are not responsible for:

• Third-party websites or services accessed through our VPN
• Content you access or transmit
• Actions of third parties

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAVACH VPN SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Cost of substitute services
• Any damages arising from your use or inability to use the Service

10.2 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Kavach VPN and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

• Deleting your account in the app settings
• Contacting us at support@kavachvpn.com

12.2 Termination by Us

We may terminate or suspend your account immediately, without notice, for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Non-payment of subscription fees
• At our sole discretion for any reason

12.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data (subject to our Privacy Policy)
• Provisions that should survive termination will remain in effect

13. Dispute Resolution

13.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@kavachvpn.com to attempt informal resolution. We will work with you in good faith to resolve any issues.

13.2 Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.

13.3 Arbitration Agreement

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except:

• Claims that qualify for small claims court
• Claims for injunctive relief

13.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Email notification
• In-app notification
• Updating the "Last Updated" date

Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Service Availability and Maintenance

13.1 Uptime

While we strive for maximum uptime, VPN services may be temporarily unavailable due to:

• Scheduled maintenance (announced in advance)
• Emergency security updates
• Server issues or technical problems
• Network outages beyond our control
• DDoS attacks or other malicious activities

13.2 No Service Level Agreement (SLA)

We do not provide a specific uptime guarantee or SLA. However, we monitor our infrastructure 24/7 and respond quickly to any issues.

13.3 Maintenance Windows

We perform maintenance during low-traffic periods when possible and will:

• Notify users at least 24 hours in advance for scheduled maintenance
• Minimize disruption by rotating maintenance across servers
• Provide status updates during extended outages

14. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to:

• Natural disasters (earthquakes, floods, fires)
• War, terrorism, or civil unrest
• Government actions or regulations
• Internet or telecommunications failures
• Cyber attacks or hacking attempts
• Power outages or infrastructure failures
• Pandemics or public health emergencies

During force majeure events, we will make reasonable efforts to restore service as quickly as possible.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kavach VPN.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 Waiver

Failure to enforce any right does not constitute a waiver of that right.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

15.5 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control.
